New lender same issue…

I posted not too long ago about almost losing earnest money and yet again I’m in the same spot because of the HOA last day I’m finally about to close but find out my lender won’t close because of hoa delinquencies is over 15%. How the hell is the hoa gonna tell us about this on the day of closing. We weren’t able to extend the contract and I might lose my earnest money now. Is there a way to fight this?? I genuinely don’t understand how this could possibly be on me and I don’t get my earnest money back I called the company and they said the contract has ended so they don’t have to give it back what are my options?

The realtors like to use the phrase "one to buy; two to sell", which seems like a broad-stroke statement which is not applicable under all circumstances. And of course, the realtors don’t realize the details of my specific circumstances: I purchased and paid for the house in full prior to marriage Only my name is on the deed And most importantly, we have never lived in the house as a marit...
