First time home buyer in South Florida.
Prior to making a deal there’s a small parcel in front of my land/house. I asked my agent to ask listing agent to find out who owns smaller parcel which I have to go through per “right of way” to access my lot.
Was informed by listing agent they didn’t know who owned it and we were unable to locate an address for it either. Due to being overly excited we put an offer and went under contract instead of doing more research.
(We are purchasing a house from an investment company from California. Their listing agent is also their property management company)
After our survey, we were then informed of setback rules which would ruin our plans to build on this property. I did my own research and later discovered that the company we are purchasing the house from ALSO owned that small parcel.
I shared to my agent that I felt misled and lied to as this smaller parcel already gave me doubts in the 1st place. He shared to the listing agent who claimed she had no idea her client ALSO OWNED that parcel. So we asked to find out their plans for the parcel and if they are willing to let it go (for a price or as part of the original purchase of sales agreement)
A week later the listing agent informed my agent that the company has no use of such small parcel (25ft by 50 ft) and decided to give/let go of that parcel via QUIT CLAIM DEED. And that I would have to file it and pay the fees ONCE WE CLOSE ON THE HOUSE this Wednesday.
I asked my agent to create an addendum to bind said parcel/earn a guarantee that this COMPANY WILL give up that parcel. He stated by adding to current contract, it might jeopardize our current deal with the lender/approval process.
I asked for the alternative which would be a letter or statement stating said plans for the small parcel to be given to us once we closed, in which my agent responded with “I have it in writing and text which should be enforceable”
May I have advice on this process? I’m still pushing for a letter but am I also verthinking this? The deed on public records shows the company owning this parcel. Thank again
