How bad is this? We got this email from our realtor, forwarded from the seller's attorney:
"The seller sold the neighboring lot 11 to “neighbor’s name” however the deed references plat book B408 at page 9 that shows lot 11 and 12 as one unified lot. Due to this it’s arguable that lot 12 was sold in that transaction so we are having to get a deed back from “neighbor” for lot 12. To make it a little more complicated, “neighbor” also has a mortgage on the property so we have to get a partial release of that mortgage for lot 12. I’ve let the attorney from that closing know what we need and they are going to start working on it. The deed back from “neighbor” I don’t think will be that difficult but the partial releases can often take some time to obtain.
Essentially, it appears to me that our neighbor technically owns our lot. The title shows only lot 11, but the deed shows 11 & 12 as one property. Both are new builds, lot 11 closed in April of '24, we are buying the house on lot 12, supposed to close 5/30.
We have a closing attorney that we have reached out to, as well.
