Supposed to close a week from today. Everything is packed for our cross country move. We have done all the things needed to call the home ours next week.
Last night, realtor calls me and says there is an encroachment that is being disclosed.
Disclosure is supposed to be given within 5 days of contract agreement. That was a couple weeks ago. The fence was built encroaching on someone else's property for a total of 1196 sq ft. The property being encroached on is not approachable from anywhere else, it slopes like crazy and is unsuitable for building. There is, however, a relatively flat spot by the encroached spot that is decent for camping, apparently. A letter was sent certified last year to the seller.
Is there legal action based on misrepresentation of the property? Perhaps we can seek damages and pay for our move? We are homeless in a week so i would rather not find a different home, theres not much out there we like on the market.
