I am in the process of investing a vacant lot and found the easement on title back to ~1970 when old seller (not current seller) reserved the easement for him to pass through. Formatted as the following.
An easement for a right of way and incidental purposes, recorded 1970 as Instrument No. XXXX of Official Records.
In favor of: XXX (old seller's name back to 1970 grant deed)
I have a quite naive question - Does the easement go away when the specified person passed away or will it get inherited? This easement cuts the lot in half and impacts the development a lot. (and apologize if this question sounds very naive)
