I know the contract stipulates that the seller shall give the buyer a clean title at the time of closing, however, how can I be sure of this? Do I need to hire a title company or lawyer to conduct a thorough search, or will the deed itself say “clear title” when it is transferred to my name?
Reason I ask is because of a pending court case as a lien on a house I want to buy, which I have been assured will be removed at the same day as closing.
We do have title insurance, and our title insurance company is confident that it will be removed, but I’m just curious how folks actually know that they’re receiving a clean title when it’s transferred to their names.
