Do's and don'ts in a listing presentation.

I went on a listing appointment the other day and I invited a colleague with to be a fly on the wall. (I never got the opportunity to hear someone else's listing presentation.) We walk thru the house and I gave some staging and cosmetic repair suggestions. After words we spoke about it and both thought it went really well! (Short story)

The next morning I got an email from the seller who was upset. She said when I bought the house with you, your spouse was the listing agent and you never pointed any of these things out and were going to explore their options(new agent and legal)

I'm like, holy crap! I was working at the company I owned with my spouse and we had sold it.

Thoughts going thru my mind. Is my E and O gap insurance still valid? Does the company who bought our business still have the files?

Did I have my cloud back up at the time of this transaction?

I called my spouse and shared the email I had received, we both began working on the research to formulate the reply. He found some documents and the home inspection report along with the attorney review letter both of which addressed the issues. I also found a letter that offered a substantial repair credit(the buyers were very thorough) that addressed all home inspection deficiencies.

I formulated a response with in 3 hours and sent it. The seller never responded. Finally on day four I called to follow up and she picked up and said, "I was going to call you, thank you for sending over the information I am working on addressing the deficiencies that were in the letter." Also one of my neighbors made us a cash offer, we will let you know by Friday what we are going to do. Friday has come and gone with no reply. I want this listing. I will definitely follow up today.

Here is what I learned.

  1. Always keep a cloud back up of all files. If you leave your brokerage and don't have a backup it could take forever to get the info you need.

  2. Always put a subject in your emails

  3. Always put things in writing. If you agree to something verbally make sure to recap the conversation in an email.

  4. Never get emotional or defensive in email responses. It does not help the cause.

  5. Make sure you have proper insurance. That includes health insurance!(Even though I probably don't need it in this case I'm glad I bought gap insurance).

Aren't comps/CMAs useless with buyer credits at close happening now?

I'm looking into buying a new construction townhouse in my HCOL US city. I'm seeing builders offering interest rate buydowns worth $20k-$60k on $800k homes (rather than just lowering prices) in order to keep their comps high for their other units, now that buyer demand has been declining. I asked my agent about these, and he said these buydowns aren't even the full story: buyers can write all kinds of other credits into an offer, like their closing costs, prepaid sewer fees, etc. Apparently cash buyers can just write in a "buyer credit at close" for any amount in their offer. So a new townhouse that appeared to sell for $800k in the MLS might have actually been a cash offer with a $100k+ buyer credit at close, meaning the buyer only spent $700k or less in total, but to the rest of the world they can only see the $800k! So that made me realize I can't trust comps/CMAs for other new construction townhouses. The sales prices could be way lower than they appear...

Pool fill without engineer oversight

We are in the process of purchasing our first ever home in CA and we just discovered in the disclosures that the new build property we are purchasing previously had a swimming pool which was filled without an engineer onsite to approve the work (details from disclosure below). Is this something we should be concerned with or not? Is it something we should have additional inspections conducted on? We are originally from the UK and not really sure what to do with this information and if it is concerning or not. A POOL DID EXIST PREVIOUSLY. Making offers on houses not listed for sale.

I want to buy a home for retirement. I am looking at lots of options, mostly focusing on the locations that appeal to me. I see lots of Zillow estimates of homes that look like great deals to me. Are these estimates accurate, even though similar houses in the same area that are for sale are usually priced much higher? If so, is it realistic for me to try to make offers to owners that do not have their homes listed? Would a realtor even consider helping me do this? Or, do these values indicate that the houses listed for sale are overpriced, and I should just lowball until someone accepts?
